Privacy Policy

What personal data FreelanceKar collects, why, who sees it, and what you can ask us to do with it.

Draft pending legal review. This replaces a version with two material errors: it stated that we do not collect government identity numbers, when the product asks for an identity document and a verification video; and it relied on the US–EU Privacy Shield, which was invalidated in 2020. Compliance with India’s Digital Personal Data Protection Act, 2023 needs confirmation by a qualified lawyer.

01Who is responsible

FreelanceKar (registered entity name to be confirmed) decides how and why your personal data is processed on FreelanceKar. Registered address: To be confirmed.

02What we collect

You give us:

  • Name, username, email address, phone number, gender and password.
  • Profile content — photo, biography, skills, hourly rate, employment and education history, portfolio, certifications, testimonials, résumé.
  • Project content — briefs, messages, files, deliverables and dispute submissions.
  • Payout details — bank account, UPI or other payment identifiers.
  • Identity verification material. See section 3.
  • Billing details, including a GSTIN where you provide one.

We record as you use the platform:

  • Account and security events — sign-ins, sessions, password changes.
  • Transaction records — projects, milestones, payments, wallet movements, invoices.
  • Technical data — IP address, browser and device information, pages viewed.
  • Anti-fraud signals. We store hashed IP and device identifiers to detect referral abuse and duplicate accounts.

We receive from others:

  • From Google, GitHub or LinkedIn if you sign in with them — your basic profile and email, and access tokens we hold to keep the connection working.
  • From payment providers — the status of your payments. We never receive or store your full card number.

03Identity documents and verification video

To reduce fraud and to enable payouts, we may ask you to upload a government-issued identity document and record a short verification video. We store the document image, the type of document, and the video.

  • Verification is reviewed by a member of our team, not decided automatically.
  • This material is used only to confirm you are who you say you are, and to meet legal obligations. It is never used for advertising and never sold.
  • You can decline. Some features, including withdrawing money, may then be unavailable.
  • You can ask us to delete it once verification is complete, unless we are required to retain it.
The previous policy said we do not collect government identity numbers. That was wrong, and it is corrected here rather than quietly dropped.

04Why we use it

  • To run your account and the contract between us — registration, profiles, matching, messaging, projects.
  • To move money — escrow, payouts, invoices, and the tax records we must keep.
  • To keep the platform safe — verifying identity, detecting fraud and abuse, enforcing our Terms.
  • To support you — answering questions and resolving disputes.
  • To improve the product — understanding which features are used, and diagnosing faults.
  • To comply with the law — tax, accounting, and lawful requests from authorities.

We rely on your consent, on performing our contract with you, on our legitimate interest in a safe platform, and on legal obligation, depending on the purpose. Where we rely on consent you may withdraw it at any time.

We do not sell your personal data, and we do not use it to train third-party AI models. Where AI features assist you on the platform, the output is a suggestion — no decision with a legal or similarly significant effect on you is made by automated means alone.

05Who we share it with

  • Other users — your public profile, and within a project the details the other party needs. Your email, phone and payout details are not shown to other users.
  • Payment providers (Razorpay, Stripe) — to take payments and make payouts.
  • Service providers — hosting, email delivery, file storage, error monitoring. They act on our instructions.
  • Authorities — where the law requires it, or to establish or defend a legal claim.
  • A buyer — if the business is sold, under equivalent protection. We will tell you.

06How long we keep it

  • Account datafor as long as the account is active.
  • Financial and transaction recordsup to 10 years, as required for tax and audit.
  • Messages24 months.
  • Verification materialuntil verification is withdrawn, then as law requires.
  • Security and fraud logs — as long as needed to prevent recurrence.

When you close your account we delete or anonymise your data, except records we must keep for tax, accounting or fraud prevention.

07Your rights

You can ask us to:

  • Tell you what data we hold about you, and give you a copy.
  • Correct anything inaccurate or incomplete.
  • Delete your data, where we are not required to keep it.
  • Stop processing based on consent, by withdrawing that consent.
  • Nominate someone to exercise these rights if you die or become incapacitated.

Write to privacy@freelancekar.com. We respond within 30 days. We may need to verify your identity first. If you are not satisfied you may complain to the Data Protection Board of India.

08How we protect it

  • Traffic is encrypted in transit. Passwords are stored hashed, never in readable form.
  • Sensitive wallet and escrow values are encrypted at rest.
  • Access to production data is limited to staff who need it, and administrative actions are logged.
  • Withdrawals require a one-time password.
  • Rate limiting and monitoring are applied to sensitive endpoints.

No system is perfectly secure. If a breach is likely to affect you, we will notify you and the Data Protection Board as the law requires.

09Children

FreelanceKar is not for anyone under 18. We do not knowingly collect data from children. If we learn that we have, we delete it and close the account. Tell us at privacy@freelancekar.com if you believe this has happened.

10Where your data is processed

Your data is processed in India and may be processed by service providers located elsewhere. Where data leaves India we do so only as permitted under the Digital Personal Data Protection Act, 2023 and under contractual protections with those providers.

The previous policy cited the US–EU Privacy Shield as the basis for international transfers. That framework was invalidated in 2020 and never applied to transfers from India in any event.

11Changes

If we change this policy materially we will tell you at least 30 days beforehand by email or in the product. The effective date at the top shows the current version.
